Terms of Service

Welcome to GoSurvive. These Terms of Service ("Terms") govern your use of the GoSurvive mobile application and website at gosurvive.app (collectively, the "Service"), operated by GoSurvive ("we", "us", or "our"). You accept these Terms when you create an account; we record when you did and which revision you accepted.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have permission from a parent or legal guardian. Accounts we identify as belonging to players under 16 are placed in a protected mode with reduced visibility and restricted social features — see §1.10 of the Privacy Policy for how that is assessed.

2. Account Registration and Consent

To access most features you must create an account, including a guest account, which is a real persistent account subject to these Terms. Creating one requires accepting these Terms and the Privacy Policy. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to:

  • Provide accurate information during registration
  • Keep your login credentials secure
  • Notify us immediately of any unauthorized access
  • Not create multiple accounts to circumvent bans or restrictions, or to gain an advantage over other players

3. The Game

GoSurvive is a location-based game where players explore real-world locations to discover, claim, and manage virtual properties. Key points:

  • Virtual properties: buildings in the game are based on real-world geographic data. Claiming a virtual building grants no real-world ownership, rights, or claims to any physical property.
  • Virtual currency: in-game cash is virtual and has no real-world monetary value. It cannot be exchanged for real money, goods, or services.
  • Location requirement: core gameplay requires GPS access. You are solely responsible for your physical safety while playing. Do not trespass on private property or enter unsafe areas.
  • Public by design: the buildings you claim are shown to other players on a shared map under your name. Choose what you claim accordingly.

4. Acceptable Use

You agree not to:

  • Use cheats, exploits, bots, GPS spoofing, or automation tools, or fabricate step and fitness data
  • Reverse-engineer, decompile, or modify the Service
  • Interfere with the Service's operation or other users' experience
  • Upload offensive, illegal, or infringing content
  • Harass, threaten, or impersonate other users
  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Sell, trade, or transfer your account or in-game assets for real-world value

We detect several of these automatically — including spoofed locations, implausible travel, fabricated step data, and two accounts played by one person. Detection may void a result, quarantine progress, or lead to the actions in §6.

5. User-Generated Content

You may upload content such as building photos, avatars, chat messages, and custom building designs ("User Content"). By uploading User Content, you:

  • Grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute it within the Service
  • Represent that you own or have the right to share the content
  • Acknowledge that User Content may be removed at our discretion, and that building and step photos are published immediately and reviewed only after a report

6. Moderation and Enforcement

We reserve the right to moderate content, suspend or ban accounts, and take any action we deem necessary to enforce these Terms. This includes but is not limited to:

  • Removing content that violates these Terms
  • Temporarily or permanently suspending accounts
  • Resetting in-game progress in cases of abuse

Account bans and account-level actions are recorded. If you believe an action was taken in error, contact us at [email protected] and a person will review it.

7. Intellectual Property

The Service, including its design, code, graphics, game mechanics, and all related intellectual property, is owned by GoSurvive. Map data is sourced from OpenStreetMap and Microsoft Building Footprints, both under the Open Database License (ODbL). You may not copy, modify, or redistribute any part of the Service without our written consent.

8. Third-Party Services

The Service integrates with third-party services, listed in full in §4 of the Privacy Policy. Your use of those services is subject to their respective terms and privacy policies.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. Game features, virtual currency balances, and in-game assets may change or be removed at any time.

10. Limitation of Liability

To the maximum extent permitted by law, GoSurvive shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, but is not limited to, loss of data, loss of virtual items, or personal injury resulting from gameplay activities. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim. Nothing in these Terms limits liability that cannot be limited by law.

11. Physical Safety

GoSurvive involves real-world movement and exploration. You acknowledge and agree that:

  • You are solely responsible for your physical safety while playing
  • You will obey all local laws, including traffic and trespassing laws
  • You will not play while driving or operating machinery
  • You will be aware of your surroundings at all times
  • GoSurvive is not responsible for any injuries, accidents, or property damage that may occur during gameplay

12. Account Deletion

You may delete your account at any time from your profile settings. Your account is hidden from the game immediately and permanently erased after a 7-day grace period; signing back in during that window cancels the deletion. You can also download a copy of your data before deleting. See §5 of the Privacy Policy for what survives erasure in anonymised form.

13. Changes to These Terms

We may update these Terms. Each revision carries a version identifier shown at the top of this page, and we record which revision you accepted. For material changes we will ask you to review and accept the updated Terms in the app rather than relying on your continued use.

14. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration or the courts of competent jurisdiction. If you are a consumer in the European Union, you keep the protection of the mandatory laws of your country of residence.
